Who these terms are with
These terms are with NigelBuilds, based in Germantown, Maryland.
The services
NigelBuilds provides managed business automation services (“Services”) for service businesses. The Services may include configuring existing software, connecting supported tools, building Business Systems, automating defined repetitive tasks, providing monitoring and maintenance, and producing reports or operational summaries. The specific Business Systems, connected tools, permissions, deliverables and limitations for a client are defined in the applicable order, Pilot intake, statement of work or other written scope.
Business Systems
A Business System is a defined managed workflow or capability configured to produce a specific business outcome. A Business System may use one or more connected tools. Connected tools do not each consume a separate Business System unless the written scope states otherwise.
The website and demo
The site and the demo are provided as is for evaluation. Demo businesses, names and numbers are fictional and illustrative. Do not rely on demo output as advice and do not submit real personal information to the demo. Automated or abusive use of the demo is not allowed and is rate limited.
The Pilot
The 21-Day Automation Pilot is a one-time paid engagement of $1,500 that runs for 21 days from the intake call. It covers two approved Business Systems. It does not renew automatically. Its scope is listed on the Pilot page.
Pilot credit
If the client continues on a Basic, Pro or Max plan at the current published pricing, the full $1,500 Pilot fee is credited toward that plan's implementation fee. The credit is valid for 12 months from the Pilot payment.
Pilot eligibility and refund
The two Business Systems are confirmed on the intake call before setup starts, and each must be buildable from tools on the supported list on the Integrations page. If the two Business Systems the client needs cannot be supported, NigelBuilds says so before any setup work begins and refunds the Pilot fee in full to the original payment method. The Fit Check on nigelbuilds.com is a guide. Eligibility is confirmed at intake.
Day-7 guarantee
If your intake is complete and your approved systems are supported, your daily brief and two Pilot automations will be running in draft by Day 7, or we refund the Pilot.
Running is checked from the action log: a brief written on 3 different days and 2 automations that each completed at least one successful draft run by Day 7. Drafts count. No customer send is required.
Plans
Plans are a one-time implementation fee, sometimes called a setup fee, plus a monthly fee. Basic includes 2 Business Systems, Pro includes 5 Business Systems, Max includes up to 10 Business Systems. An Extra Business System beyond the plan is $250 a month plus a $500 configuration fee. Plan limits, tool allowances and permissions are listed on the Pricing page and confirmed in a written scope before work starts.
Cancellation
Plans are month to month after setup. Cancel with 30 days notice.
Allowance and overage
Monthly tool allowances are Basic $50 a month, Pro $125 a month, Max $250 a month. Usage past the allowance is billed at actual provider cost plus 30 percent, itemized on the invoice, up to a hard monthly cap set by the client.
Worked example: each $1.00 of provider cost past the allowance is billed as $1.30, and nothing is billed past the hard cap.
Permissions and approvals
NigelBuilds configures each Business System with defined permissions and operating rules. Services begin with the narrowest permissions reasonably required for the agreed workflow. Customer-facing sending or other mutating actions are not enabled unless specifically included in the written scope, technically configured and approved.
Business Systems are not configured to move money or issue refunds, delete records or email, change passwords, users or security settings, or give medical, legal or financial advice, unless a future written policy changes this. The client remains responsible for decisions it approves.
Third-party tools and client accounts
Clients remain responsible for their third-party software accounts, subscriptions and provider terms. NigelBuilds may connect supported third-party services when required by the agreed scope. Availability and functionality of third-party services may change outside NigelBuilds’ control. Connections not already supported may require separate scoping, implementation fees or may be declined.
Where providers allow it, connections are created inside the client's own accounts and can be revoked by the client at any time. Third-party subscriptions a workflow needs are held in the client's name.
Model providers
Some Business Systems may use third-party AI or model providers to process limited client content needed to perform the configured task. NigelBuilds uses business API accounts. Client production work never runs on personal ChatGPT, Claude or other personal AI subscriptions. The providers used for a client may vary by scope and are disclosed through service documentation or on request.
Termination, export and offboarding
On termination, NigelBuilds will reasonably assist with exporting service-generated information that is technically available and included in the client’s scope. Credentials or access under NigelBuilds’ control will be revoked or removed as appropriate. Service data will be retained or deleted according to NigelBuilds’ documented retention practices, technical backup cycles, contractual obligations and applicable law. Backup copies may persist temporarily until normal backup rotation completes.
No outcome guarantees
NigelBuilds does not guarantee revenue, savings, profit, leads or hours saved. The activation guarantee in the Day-7 guarantee section, as described on the Pilot and Pricing pages, is the only guarantee offered.
Written agreement
A signed scope or service agreement for a Pilot or plan controls if it conflicts with these terms.
